Benefits for Veterans and their Families

The U.S. Veterans Administration has made it possible for qualifying veterans or their widows to receive monthly stipends in order to pay for long-term care. These benefits—known as Aid & Attendance—can be used for in-home, assisted living, or nursing home care.

To be eligible for Aid & Attendance, a veteran must:

  • Have served for at least 30 days during a wartime era and have not received an honorable or general (but a dishonorable) discharge
  • Need daily aid and attendance
  • Be unable to pay for the care needed
  • Have less income than the costs of the care

Eligible veterans can receive up to about $2,000 each month for care, and their widows can receive around $1,000 each month.

Should You Apply for Aid & Attendance?

Depending on the costs of the care you are looking to receive, Aid & Attendance benefits can be helpful. However, if your long-term care expenses exceed thousands of dollars each month (such as with nursing home care), you may need to get Medicaid instead to cover the expenses. There will also be a months-long delay after applying to the Veterans’ Administration while they verify your eligibility.

Aid & Attendance benefits are easier to get when your pre-planning and application are done right, so if you feel this is the right solution for you, call Marks Elder Law right away to begin arranging your assets in order to qualify. By acting quickly, you can safely secure your estate before earning benefits.

What Do Applicants Need to Do?

According to the Veterans’ Administration guidelines, applicants must prove their long-term care costs are higher than their expected ability to pay based on assets and income. If you have or make too much money, your request will be denied on the grounds that you can afford it yourself. To ensure that your finances meet their requirements, you should meet with a Pittsburgh elder lawyer to make the right decisions.

Ways to reduce excessive net worth can include:

  • Creating accounts jointly held with your children
  • Establishing an Asset Protection Trust to forfeit control
  • Gifting money away

Applying for long-term care benefits under Aid & Attendance is complicated. By working with an experienced Pittsburgh estate planning lawyer, you can better understand your options and how to move forward.
